The information below outlines the accommodation terms and policies of our guest suites. Once we have confirmed your reservation dates, and a credit card deposit is made, all parties are subject to the terms and policies herein and referred to as The Agreement. The Agreement is a legally a binding agreement. WE, OUR and US or the Owner mean Niemann Hamm Family LLC dba Sacred Sands. YOU and YOUR mean anyone approved as a GUEST who has signed the Accommodations Agreement. SUITE means the short term accommodations you are contracting from the Owner, known as either The Onyx Room (our king bed, master suite with master patio), or The Jade Room (our king bed, master suite with junior patio) as indicated on your Booking Confirmation. All information in the Rates and Availability page of this website are incorporated into The Agreement.

1) Occupancy: The Suite will be ready for you to occupy at 4:00pm on the date of your scheduled arrival. The term of your occupancy will end at 11:00 AM on the date of your scheduled departure. This means your occupancy will automatically end on that date at that time. If you have our permission in writing to extend your stay you may do so with a new, established end date. In this case, your fees and all the other terms will remain the same as in The Agreement, unless we tell you differently in writing. This agreement for short term accommodations does not constitute a rental agreement or establishment of permanent residency. If, after this accommodations period has terminated, and you stay in the Suite without our written consent, you will be considered trespassing and subject to legal measures.

2) Additional Guests: Each booking is for a max of two guests per room. We allow each guest to have a maximum of one visiting guest but they must vacate the property no later 10p to avoid being charged an additional room fee. Sacred Sands may be used as a special events venue only if prior arrangements have been made. 3) Billing and Cancelation Policy: If your reservation is made through a third party booking service (AirBnB, Booking.com, Expedia, etc.), the cancellation policy agreed upon through the third party supersedes The Agreement and will be enforced according to those terms. Any change to a reservation booked through a third party provider must be initiated by the Guest. Sacred Sands will not be able to make any changes to Guest's reservation booked through a third party without the Guest first initiating the request through the appropriate procedure for reservation changes on the third party's platform.

For all standard bookings made directly by phone or through SacredSands.com, a 50% deposit is required after 24 hours. Reservations confirmed at least 72 hours before check-in date have 24 hours to cancel free of charge according to CA law. After this period has expired the first 50% deposit is made 24 hours after the reservation is confirmed for stays more than 14 days in advance. For reservations made within 14 days of arrival the full charge is due 24 hours after confirmation.Full refund, less a credit card service fee of 6%, will only be made for cancellations if the check-in date is at least 15 days away. Alternatively, if the check-in date is at least 15 days away, guest can request to apply their balance towards a future visit (some blackout dates and rate changes may apply). The remaining balance of your stay is charged 14 days prior to your arrival and no refund or credit can be offered for cancellations made within 14 days of check-in. No exceptions to the cancelation policy will be made due to COVID-19. Guests are encouraged to purchase trip insurance if they are unsure they will be able to make their scheduled booking. No shows will be charged the entire amount of the reservation and will not qualify for rescheduling or credits of any kind. If guest decides to check out early, no refund or credit, in full or part, will be given. All room rates are subject to state and/or local taxes.

4) Security Deposit: At time of check-in, you give us permission to make a credit card authorization in the amount of $250 to be held as a security deposit for loss, damage and incidentals. Shortly after you check out we will assess the room for loss and damage. If everything is how it was found we will refund your safety deposit immediately. You agree to be liable for any damages caused by you or your party during your stay. Your liability for damages can result from the loss of any property as a result of your stay, to repair or replace any property that are damaged or missing, stained linens, or for cleaning fees in violation of our no smoking or no pet policy. Should loss and damage exceed over $250 guest consents to be charged the exact remaining amount in repairs/replacements.

5) Fires: Joshua Tree is prone to fire and guests are not allowed under any circumstances to create an outdoor fire in their guest quarters or use portable camping stoves, candles, or any other incendiary devices anywhere during their stay. Fires are only permitted in the Great Room fireplace or outdoor chimenea except during high wind advisory periods issued by the National Weather Service. Check local listings for details.

6) Smoking tobacco: Sacred Sands is a tobacco-free facility and smoking is strictly prohibited. Smoking tobacco in any interior spaces is strictly prohibited and per this agreement you authorize us to make an additional $1000 cleaning fee on the credit card on file if guests are found to violate our no smoking policy. Guests found smoking tobacco in the rooms may have their reservation cancelled and asked to leave the property immediately at their own expense.

7) Appliances and electronic equipment in the Suite are provided for your complimentary use (see Amenities). No refunds will be given for malfunctions, though we will make a good faith effort to repair or replace defective items as soon as is practical.

8) WiFi: WiFi is provided free of charge with no claims to speed or performance. Guests should note that Sacred Sands is in a remote rural area and is equipped with the highest speed internet available in this area. However, some guests may find it is slower than they are accustomed to in an urban environment.

9 ) Force Majeure: Neither party hereto will be liable or responsible to the other for any loss or damage or for any delays or failure to perform due to causes beyond its reasonable control including, but not limited to, acts of God, strikes, epidemics, pandemics, war, riots, civil unrest, flood, fire, tsunami, volcano, sabotage, air space closure, ground stop(s), a U.S. Department of State Travel Warning or any other circumstances of like character (“force majeure occurrence”), closure of our business for any reason, or factors outside of Owner’s control, Owner is unable to deliver Suite to Guest at time of check in, Guest’s sole remedy shall be a credit towards a future stay within one year of the date of cancellation. In this case, Owner shall not be liable and shall be held harmless from any damages or costs incurred by Guest or any other parties. Owner will not be responsible for locating or securing alternative lodging, airfare, car rental or any other related items or expenses. For this reason, we highly recommend that you purchase travel insurance from a reputable company.

10) Keys: There will be a key code assigned to you upon arrival. If you have trouble with the key pad a key can be provided only after the lock has been examined by management. You may not have additional keys made or locks changed or added. You must return the key when you depart, by handing it to the Owner or leaving it in the Suite or paying to replace it. The amount charged for replacement keys will be $25 per key.

11) Plants and Wildlife: Due to the desert flora and fauna surrounding us we encourage all guests to wear closed-toe shoes and stay on designated trails to preserve the fragile ecosystem. If you decide to hike at night please use a flashlight or headlamp and wear closed-toe shoes as guests may encounter snakes, tarantulas and other wildlife in this natural settings. Always bring plenty of water before ever setting out on foot.

We do our best to ensure the patio is free of debris but we cannot prevent airborne thorns and stickers that may be present on the patio. Guests use the patio areas at their own risk and cannot hold Sacred Sands liable for any injury as the result of improper footwear or other causes. Sandals, flip-flops or shoes are required on the back patio at all times. No glass is allowed in your private patio area. Shatterproof wine glasses will be provided for use in the back patio.

12) Guest Liability: You agree to accept all liability and hold Owner and Management harmless for the use of the Suite, any equipment, furnishings and appliances supplied by or borrowed from Owner and used by Guest or Guest’s guests. We are not responsible for loss of any kind.

By signing The Agreement, each Guest agrees to pay the accommodation fees and be liable for any additional fees incurred and accept and obey the terms, conditions and policies contained herein. If paying by credit card, you authorize us to make any charges to the credit card provided in accordance with The Agreement. You also certify that you are either an authorized signer of the credit card provided or have been authorized to use it by the cardholder.

13) You May Not Sublet, Illegal Activities, etc: You may not sublet, or let anyone else occupy the Suite or replace you as the Guest, unless you have our written permission in advance. The Suite may be used only as a short term accommodations for the Guests listed in The Agreement. You may not use it for any improper or offensive purpose, including any activity that violates any law or governmental regulation. Additionally, any activities by you or any of your guests that violate The Agreement will be considered as cancellation of The Agreement and immediate termination of tenancy. Possession of the Suite obtained by fraud or misrepresentation will also be considered as cancellation of The Agreement and immediate termination of tenancy.

14) Applicable Law, etc: The Agreement shall be construed according to the laws of the State of California, without giving force or effect to the choice of laws provisions thereof. If any part of The Agreement should be deemed unlawful or invalid for any reason whatsoever, the validity of the remainder of The Agreement shall not be affected thereby. The Agreement shall be incorporated with the signed Booking Confirmation provided to the Guest at time of check-in and the terms set forth herein shall be considered the entire Agreement between the parties and shall supersede any other agreements, whether oral, written, expressed or implied.

15) In accordance with San Bernardino County requirements the following policies apply:

A. Quiet hours shall be maintained from 10:00 p.m. to 8:00 a.m., during which noise from Guest shall not disturb anyone on a neighboring property; B. Amplified sound that is audible beyond the property boundaries of Sacred Sands is prohibited;C.Vehicles shall be parked in the designated onsite parking area and shall not be parked on the street.

16) INDEMNITY: GUESTS FOR THEMSELVES AND THEIR RESPECTIVE HEIRS, GUESTS, PERSONAL REPRESENTATIVES, SUCCESSORS AND ASSIGNS HEREBY RELEASE THE OWNER OF THE PROPERTY, ACCOMMODATIONS BUSINESS, OFFICERS, AGENTS, EMPLOYEES, PARTNERS, SURETIES, INSURERS, INDEMNITOR, ATTORNEYS, SUCCESSORS AND ASSIGNS FROM ALL CLAIMS, DEMANDS, OR CAUSE OR THING WHATSOEVER RESULTING FROM OR IN CONNECTION WITH THE PROPERTY OF THIS RENTAL AGREEMENT AND CONTRACT INCLUDING WITHOUT LIMITATION ANY CLAIM, DEMAND OR CAUSE OF ACTION FOR PERSONAL INJURY OR DEATH AND ANY AND ALL LOSS, LIABILITY, COST AND EXPENSE RESULTING FROM ANY CLAIM, DEMAND, SUIT OR CAUSE OF ACTION WHICH MAY BE ASSERTED.
